Terms & Conditions I. Antecedents. The Best Spanish Horses (from here onwards known as TBSH), is an established business specialising in the intermediation of the sale of: Pure Bred Spanish Horses (Andalusians), Lusitanos, Hispano-Arabs and other cross-breeds. Its objective is to find the Pure Bred Spanish Horse (Andalusian), Lusitano, Hispano-Arab or other cross-breed most suited to the client, and from thereon, facilitate and initiate negotiations with the seller towards the sale of the horse. II. Requesting the search service. The person wishing to acquire a Pure Bred Spanish Horse (Andalusian), Lusitano, Hispano-Arab or other cross-breed via TBSH’s services, should fill-in the initial search form – which will be sent to them - defining the characteristics, future purpose and details of the horse intended to purchase. This process facilitates the selection process and will guarantee the most suitable horse to the buyer’s needs and requirements. Once the client has completed the search form and sent it back to TBSH; TBSH will then immediately begin the search for such a horse. Once TBSH has selected the most suitable candidates, the client shall receive a list of these including each horse’s characteristics, details, photographs (videos when previously requested and therefore may be obtained) and price – in Euros or Pounds sterling depending on the country in which the horse is located. This procedure then allows the client to decide which horse is most suited to their requirements. Once a horse has been chosen by the buyer they should then inform TBSH, so the company may begin initiating the purchase process. Once the buyer has confirmed to TBHS their intention to purchase, TBSH will contact the horse’s seller/proprietor x to inform of the sale and begin the purchase process which concludes with the sales contract. In all cases, it is highly recommended that the client interested in purchasing a horse come to view the horse in person previous to purchase. It is also suggested the buyer carry out a standard veterinary check-up until they are completely satisfied with the horse. Should the client choose to ignore previous suggestions and not view the horse in person prior to purchase, it should be made clear they are purchasing without viewing and the responsibility is their own. TBSH will accompany the client to view the selected horse/s and introduce them to the seller/proprietor. III. Professional Fees and way of payment. Professional fees – The fees TBSH is to receive for their equine search and localization services will be pre-determined by each case’s formal sales conditions. Only when the sales process for the chosen horse has been completed and fully carried out will TBSH have the right to receive their professional fees, plus IVA (VAT). TBSH's professional fees will be received at the moment of handing over the invoice, at the moment of the purchase contract signature between buyer and seller. IV. Costs. Costs that may arise for TBSH regarding transportation for viewing and searching of horse/s shall be included in the professional honoraries once the selected horse/s has been purchased. However, an additional fee may be required to be paid in full up front from the client, depending on the selected horse/s location. This is merely to cover the company’s transportation costs should the selected horse be located a considerable distance away. V. Guarantees. TBSH’s services, guarantees: 1. - All the selected horses are Pure Bred Spanish Horses (Andalusians), Lusitanos, Hispano-Arabs and/or other cross-breeds. 2. – That the sellers/proprietors/breeders are the legitimate owners of the horse/s. 3. – That all information regarding the requested and selected horse/s is true, up to date and factual. VI. Responsibility. In accordance with articles 1.491 to 1.499 of the Civil Code which determines the Applicable rules regarding the health and eviction by hidden vices within the sale of the animals, it is established as a general principal that the seller will indicate and rid animals of all vices and defects of this nature. VII. Jurisdiction. Both parties agree, if necessary, to be put under the jurisdiction of the Málaga Courts and Tribunals. All controversies derived from the interpretation or execution of this contract shall be prevailed by the Spanish Legislation.
